Terms of Service

1. What PoolManFinder Is (and Is Not)

PoolManFinder.com ("PoolManFinder," "we," "us") operates an online directory and referral platform that connects homeowners ("Users") with independent pool service professionals ("Professionals"). PoolManFinder is not a pool service contractor, subcontractor, broker, agent, or employer of any Professional. We do not perform, supervise, direct, warrant, or guarantee any pool cleaning, maintenance, repair, or related work.

2. The Directory Relationship

• Any quote, estimate, agreement, or contract for services is entered into solely between the User and the Professional.
• PoolManFinder is never a party to any service agreement and has no responsibility for the performance, quality, pricing, timing, or outcome of any work.
• All payments for services are made directly between the User and the Professional. PoolManFinder does not collect, hold, escrow, or process payments for pool services.

3. No Endorsement or Guarantee

Listing a Professional in the directory does not constitute an endorsement, recommendation, certification, or guarantee. While we may perform basic verification checks (such as business registration or license confirmation where provided), we make no representation that any Professional is licensed, insured, bonded, or qualified. Users are solely responsible for verifying licensing, insurance, and references before hiring.

4. User Content & Photo Uploads

By uploading a photo of your pool, you represent that you own or have the right to share it, and you grant PoolManFinder a non-exclusive license to transmit it to up to three (3) matched Professionals for the sole purpose of preparing a quote. Do not upload images containing people, or content you do not have rights to.

5. Consent to Be Contacted

By submitting a quote request and checking the consent box, you provide express written consent to be contacted by PoolManFinder and up to three (3) Professionals at the phone number and email you provided, including via automated technology, SMS, prerecorded messages, and email, regarding your request. Consent is not a condition of any purchase. Message and data rates may apply. You may revoke consent at any time by replying STOP or contacting us.

6. Professional Terms

• Professionals are independent businesses and must maintain all licenses, permits, and insurance required in their jurisdiction.
• Quote Credits and subscription fees are for access to the platform and quote-delivery services only; they are not commissions, referral fees tied to job completion, or payments for employment.
• Fees are earned when a quote is transmitted to a User and are non-refundable except as required by law.
• Professionals must comply with all applicable laws, including telemarketing and consumer-protection laws, when contacting Users.

7. Limitation of Liability

To the maximum extent permitted by law, PoolManFinder shall not be liable for any indirect, incidental, consequential, or punitive damages, including property damage, personal injury, lost profits, or disputes between Users and Professionals, arising out of or related to the platform. Our total liability shall not exceed $100.

8. Indemnification

Users and Professionals agree to indemnify and hold harmless PoolManFinder from any claims, damages, or expenses arising from (a) their use of the platform, (b) any services performed or failed to be performed, and (c) any violation of these Terms or applicable law.

9. Dispute Resolution

Any dispute with PoolManFinder shall be resolved by binding individual arbitration, and you waive the right to a jury trial or to participate in a class action. Disputes between Users and Professionals must be resolved directly between those parties.
